Schulenburg man sentenced to 34 years in prison

Shane Machicek was found guilty of murder that occured on June 24, 2023 in Schulenburg. Machicek claimed self defense in the murder of his father, Ricky Machicek, 64, of Schulenburg.

The defendant claimed self defense as a reason for the murder, altough no weapon was found on the victim as reported by Schulenburg Police Officer Byron Powe. But during the investigation, he told the Texas Rangers he did leave the house to retrieve his firearm from his vehicle and returned. He claimed it was an ac- cidental discharge during a fight with his dad. During trial testimony, a relative of the defendant said that the de- fendant was five to six feet away from the victim, the defendant raised his arm and pulled the tirgger. The victim fell where he was standing. In further testimony by the DPS Crime Lab, because of the trajectory of the bullet, the victim fell where he was standing when he was shot. According to another witness, the defendant moved the firearm and the shell casing closer to the body of the victim.

After testimony from both the prosecution witnesses and defense rebuttals, the jury found the defendant guilty and sentenced Machicek to 34 years in prison. He could have received up to 99 years in prison.
